Terms of Service

These Terms of Service (“Terms”) apply whenever you book a treatment, purchase a gift voucher or product, or use the website chindavidthaimassage.site. By making a booking or using our website, you agree to be bound by these Terms. If you do not accept these Terms, please do not use our services.
1. About us
Chindavid Thai Massage and Spa Pty Ltd (ABN 82 702 495 378) operates a traditional Thai massage and day spa business in Melbourne VIC. All correspondence should be directed to ceo@chindavidthaimassage.online.
2. Our services
We provide traditional Thai massage, foot massage, aromatherapy oil massage, hot herbal compress therapy and day spa packages. All treatments are provided for relaxation, comfort and general wellbeing. Our services are not medical treatment, physiotherapy, diagnosis or cure for any condition, and our therapists do not diagnose medical conditions. If you have a health concern, please seek advice from your doctor or another qualified health professional before booking.
3. Bookings and appointments
Bookings may be requested through our website, including the quote and contact pages, or by email. A booking is confirmed once we reply by email with a date and time. Please arrive five to ten minutes before your scheduled appointment. If you arrive late, your treatment may need to be shortened so that following clients are not delayed, and the full price still applies.
4. Cancellations, rescheduling and no-shows
We ask that you provide at least 24 hours’ notice if you need to cancel or reschedule an appointment. Bookings cancelled with less than 24 hours’ notice, or appointments that are missed without notice, may attract a cancellation fee of up to 100% of the booked price at our discretion.
Where we need to cancel or reschedule your appointment for reasons beyond our control, we will offer you a choice of a full refund of any prepaid amount or a rebooked appointment at no extra cost.
5. Pricing and payment
All prices are quoted in Australian dollars and include GST where applicable. Payment is due at the completion of your appointment unless the treatment was prepaid. Accepted payment methods are as displayed at our premises or confirmed at the time of booking. Prices may change from time to time; the price confirmed when you book applies to that booking.
6. Health, safety and your responsibilities
Before your treatment, you must tell us about any relevant health matters, including pregnancy, recent surgery, recent injury or fracture, high or low blood pressure, heart conditions, diabetes, epilepsy, allergies, skin conditions, and any medication you are taking. Some treatments may be unsuitable in certain circumstances, and we reserve the right to decline or modify a treatment for your safety.
During your treatment, please tell your therapist immediately if the pressure is uncomfortable or if you feel unwell. Please do not attend an appointment under the influence of alcohol or intoxicating substances, and please arrive clean, having showered beforehand. Clients under 18 years of age must be accompanied by a parent or guardian, and written parental consent is required before treatment.
7. Client conduct
All clients are expected to treat our therapists and staff with courtesy and respect. Any inappropriate, abusive, harassing or sexual conduct towards our staff will result in the immediate termination of the treatment, the full price remaining payable with no refund, possible referral to Victoria Police, and refusal of future bookings.
8. Personal belongings
Where lockers or secure storage are available, please secure your valuables before your treatment. To the extent permitted by law, we are not liable for loss of or damage to personal property you bring to our premises, except where such liability cannot be excluded under Australian law.
9. Gift vouchers
Gift vouchers are redeemable for our services and are subject to availability. Gift vouchers sold to consumers are valid for at least three years from the date of purchase, as required by the Australian Consumer Law. Gift vouchers cannot be redeemed for cash, and we are not required to issue a replacement for a lost or stolen voucher, although we may do so at our discretion.
10. Health fund rebates and third-party claims
Unless clearly stated at the time of booking, we do not process private health insurance claims on your behalf. Any eligibility for a rebate depends on your insurer, your level of cover and their recognition of the treatment, and we make no guarantee that a rebate will be available.
11. Consumer guarantees under Australian law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other law that cannot lawfully be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for any amount prepaid, less the value of services you have already received.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage caused by our failure to provide the services. If the failure does not amount to a major failure, you are entitled to have the failure rectified within a reasonable time, and if we fail to do so, to cancel the service contract and obtain a refund for any unused prepaid services.
Goods (such as oils, gift packs or other products sold by us) also come with guarantees that cannot be excluded under the Australian Consumer Law. If a product has a major failure, you may choose between a refund or a replacement. If the failure is not a major failure, we may, within a reasonable time, repair or replace the product or provide a refund.
12. Limitation of liability
To the maximum extent permitted by law, and except as set out in section 11, our liability to you arising from our services or these Terms is limited to the price paid for the relevant treatment or product. We are not liable for indirect or consequential loss, except where such liability cannot lawfully be excluded. Nothing in this section limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under Australian law.
13. Complaints and disputes
If you are unhappy with any aspect of our service, please contact us at ceo@chindavidthaimassage.online. We aim to acknowledge complaints within two business days and to resolve them fairly and promptly. If we cannot resolve a dispute, you may contact Consumer Affairs Victoria or another applicable external dispute resolution body.
14. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.
15. Intellectual property
All content on this website, including text, images, logos and branding, is owned by or licensed to Chindavid Thai Massage and Spa Pty Ltd. You may not reproduce, distribute or reuse any part of this website without our prior written consent.
16. Website information
Information on this website is of a general nature, may change from time to time, and is provided in good faith without warranty as to its accuracy or completeness. Website content is not medical advice.
17. Changes to these Terms
We may update these Terms from time to time. The current version is always published on this page, and the version in force on the date you make a booking applies to that booking. Continued use of our services after changes are published constitutes acceptance of the updated Terms.
18. Governing law
These Terms are governed by the laws of Victoria, Australia, and both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
